Medical malpractice suit follows after slow removal of lithium batteries

Florida parents Cole Parsons and Courtney Thorne filed a medical malpractice suit on Wednesday, December 28. They filed against Jacksonville-based Wolfson Children’s Hospital and Dr. David Smith. The parents are claiming their baby suffered severe burns from the lithium battery she ingested because the physician took around five hours to remove said battery from the baby’s body.

According to data from the National Capital Poison Center, over 1,900 children swallowed button batteries in 2015. Among these cases, there were 20 deadly incidents in children younger than six. Parsons said other doctors noted their daughter may need continuous treatment to mend her esophagus. Because of the wounds in her esophagus lining, she can eat only pureed food.

Antibacterial soap ingredients banned by FDA

The United States Food and Drug Administration ordered a ban of 19 chemicals used as active ingredients in antibacterial soap, as well as hand and body wash.  On September 2, the FDA noted that companies have a year to take out these ingredients from their products. They banned nineteen chemicals as a result of this action.

Several companies have already done away with triclosan. Instead, they use one of three other chemicals – benzalkonium chloride, benzethonium chloride, or chloroxylenol – as active ingredients in their antibacterial products. However, some companies are not budging. For instance, Dial’s “All Day Freshness” antibacterial soap, contains triclocarban as an active ingredient.

More Americans are getting killed by accidents each year

A new study released by the National Safety Council (NSC) showed that accidents, especially falls and overdoses, are causing the deaths of more Americans each year.

The NSC said that in 2014, over 136,000 Americans died in accidents. Unfortunately, that is an increase of 4.2% from 2013 records and a rise of 15.5% within a 10-year period. Numbers are increasing even though car accident fatalities have declined by 22% since 2005.

Furthermore, overdose deaths have risen by 78% in 10 years, dethroning car accidents as the number one cause of accidental death in the United States. Also, deaths from falls have risen by 63% over a decade.

NSC statistical manager Ken Kolosh said the American society and government need to work harder to prevent these deaths. According to Kolosh, we still have yet to exhaust all our efforts in trying to minimize instances of accidents.

Understanding personal injury claims

If you believe that your accident and injury was caused by the negligence of another person, there is good reason for you to begin exploring what compensation may be available to you by filing a personal injury claim. Personal injury claims that are based on allegations of negligence will need to be able to demonstrate that the following are true:

  • A duty existed—i.e. not to operate a vehicle while intoxicated;
  • That this duty was disregarded—i.e. the responsible party did drive while intoxicated;
  • That an accident was caused by this disregard for duty—i.e. the accident was the result of the responsible party being intoxicated;
  • This disregard of the duty caused actual harm—i.e. you or a loved one was hurt by the intoxicated driver.

If you or a loved one was hurt in an accident that was caused by the negligence of someone else, you should consult with a Rhode Island personal injury attorney at the Law Offices of Ronald J. Resmini, Accident & Injury Lawyers, Ltd., about the legal rights and options available to you at this difficult time. To speak with an experienced and caring personal injury attorney in Rhode Island about the particulars of your situation, please call our offices at (401) 751-8855 today.

Personal Injury Attorney Rhode Island – Discusses Workers Compensation

Personal Injury Attorney Rhode Island Construction Workers at Higher Risk for Accidents Leading To Workers Compensation

Personal Injury Attorney Rhode Island - Discusses Workers CompensationWorkplace injuries can occur in any business or industry. Construction workers have one of the highest worker injury rates of any occupation in the United States. The US Department of Labor Statistics reports that in 2013, 4,585 construction workers were killed on the job, one in five worker deaths last year were in construction. This why you need to know your workers compensation rights.

According to the American Public Health Association, almost all construction workers will sustain injuries on the job at least once in their lifetimes. Data from the Occupational Safety and Health Administration (OSHA) shows that one in ten construction site workers are injured every year. According to the Bureau of Labor Statistics, there are approximately 150,000 construction site injuries each year. Workers between 25 and 34 years old are the most likely to be injured in a construction site accident, and according to OSHA, falls are the leading cause of injury at construction sites.

A construction site accident can cause serious, life-threatening injuries such as: head injuries, brain injuries, burns, blindness, loss of limbs, spinal cord injuries, disfigurement, and even death.

The majority of construction accidents are the result of OSHA violations.

Common violations include:
• Lack of fall protection
• Defective wiring and equipment
• Unstable ladders and scaffolding
• Lack of respiratory protection
• Failing to warn construction workers of hazards in specific locations
• Unsafe heavy equipment and trucks
• Site hazards including gas pipes and electrical lines
• Allowing workers to use equipment without safety guards
• Falling objects
• Missing barricades used to block off trenches and excavations

When a construction worker gets injured on the job, they may be eligible for Workers Compensation, it is estimated that 15 percent of Workers Compensation payouts are for injured construction workers.

Unfortunately, Workers Compensation benefits usually don’t provide enough money to cover the injuries sustained, in part due to the fact that most injuries involving construction workers are injuries to their backs, spines, and trunks. In some cases the injured worker may be eligible for additional compensation as well.
