Rhode Island Attorney Discusses Whiplash Injuries

Cervical_Collar_EmergencyA large number of car accidents take place every day in Rhode Island. Unfortunately, this results in a lot of people sustaining injuries during the course of the car accident.

Although many of the injuries sustained during the course of a car accident are minor cuts and bruises that won’t take long to heal, oftentimes the injuries can be much more severe. In these types of situations it is possible to receive compensation for your injuries by filing an accident claim or lawsuit.

One of the most common injuries in car accidents is whiplash, most often someone suffers a whiplash injury when involved in a rear end collision. A whiplash injury can occur in any type of vehicle accident including a head-on collision. You can sustain a whiplash injury even if the vehicle is moving at a low speed involving a minimal impact collision.

The term “whiplash” is a non-medical term frequently used to describe a range of neck injuries following a car accident. A whiplash injury occurs when the soft tissues of your neck are injured when a person’s neck is whipped backward and then forward very suddenly. The head is “whipped” backwards against the headrest, and then forward very quickly, possibly into an airbag. This flexing of the neck backwards and then forwards is what causes the whiplash.

The medical term for a whiplash is a neck sprain or neck strain. Whiplash can cause long-term pain and discomfort diminishing the quality of life. In many cases people can suffer long term effects such as chronic pain, difficulty sleeping, and problems with their concentration and memory.

Fortunately, a whiplash injury is not usually a life threatening injury; however, it can lead to a prolonged period of partial disability. The symptoms of a whiplash injury may not be immediately apparent. Symptoms will usually appear within twenty-four hours following the accident, but in some cases symptoms may not be apparent for several days or even weeks. Common symptoms include:

  • neck pain and stiffness
  • headaches (specifically at the base of the skull)
  • dizziness
  • blurred vision
  • constant weariness

Other symptoms can involve headaches, nausea, memory loss, confusion, depression, vomiting, backache and even blurred vision. Clearly with any of these symptoms it is unlikely that the person will be able to drive, nor will they be able to work. The symptoms may last for a matter of days, weeks or even months. In a few very unfortunate cases whiplash can be a permanent condition.

If you have experienced a whiplash injury and you begin to experience pain, numbness or weakness in your arms or moving your head becomes painful, you need to contact a physician immediately.

According to the National Institute of Neurological Disorders and Stroke (NINDS), about 1 of every 4 people with whiplash report symptoms for up to a year, and about 1 in 10 patients report permanent symptoms as a result of their whiplash injuries.

If you, or a loved one, have been involved in a car accident in Rhode Island and are suffering from a whiplash injury, it is essential to contact an experienced Rhode Island Attorney who specializes in whiplash cases.

Rhode Island Lawyer: What Should I Do If My Dog Bites Someone?

Rhode Island Lawyer: What Should I Do If My Dog Bites Someone?According to the Center for Disease Control and Prevention (CDC) approximately 4.5 million people in the United States are bitten by dogs. On average, only one out of every five people bitten require medical attention.

The most common victims of dog bites are children under the age of thirteen. Due to their size, children are also most likely to be severely injured by dog bites. It is believed that because most small children are not aware of how to interact with dogs, they are most likely to be bitter by dogs.

These are the most common reasons dogs bite people.

  1. Possessiveness – Dogs will “guard” what they perceive to be their property, this could be their food, their toys, their owners or the area they are in.
  2. Fear – Dogs will bite when they are afraid. Avoid sleeping dogs, do not tease dogs, never approach a dog you are unfamiliar with.
  3. Pain – Even the friendliest dog will bite if they are in pain. If your dog is experiencing pain, it is important to keep your pet away from others. If your dog’s behavior changes and they become irritable, it is important to take them to a vet for a check up to see if they are having medical issues.
  4. Maternal Instincts – Do not approach a dog and her puppies, she may bite you if she thinks you are going to hurt one of her puppies. If you are the dog owner, provide a place where the dog and her puppies can feel safe, and will not be approached by people.
  5. Prey Drive – If you jog or ride your bike, be aware that a dog may start chasing you. This is a competitive instinct in dogs, it is called prey drive. Try to avoid crossing paths with a dog if you are biking or jogging.

If your dog bites someone, your first priority is to gain control of the dog and assist the dog bite victim. Stay calm, don’t argue with the victim. If the dog bite victim needs medical treatment, call 911. You should pay the victim’s medical expenses. If the victim does not need immediate medical attention, provide your contact information to the victim, make certain to get the victim’s contact information. If there were any witnesses, make certain to get their contact information as well. Make certain that you have the dog’s updated vaccination records available. You’ll want to make certain to give the victim information about the dog’s rabies vaccinations.

Stay calm and document as much information about the incident as possible. There is a chance that the victim will take legal action against you. Do not make statement to anyone about the incident until you have spoken with a legal professional. You’ll find the help you need at the Law Offices of Ronald J. Rhode Island Attorney Discusses the Dangers of AsbestosMost people know the Dangers of Asbestos now. Unfortunately, until 1989, many people worked around asbestos and were unaware of the life threatening risks that asbestos exposure causes. Asbestos was originally thought to be safe, but it has now been proven that asbestos can cause diseases such as mesothelioma, lung cancer, pulmonary fibrosis, and asbestosis. Unfortunately, every year thousands of people suffer from diseases related to direct, household or bystander asbestos exposure.

  • None of the asbestos related diseases are curable, and most of the diseases are fatal.

  • Mesothelioma may not occur for many years after initial exposure, however, once it occurs it is a very aggressive form of cancer.
  • Mesothelioma is always attributed to asbestos exposure.
  • Until 1989, asbestos was used in many industrial and construction products such as roofing shingles, millboard, paints, floor tiles, pipes and furnace insulation materials.

The United States began to ban asbestos in certain products. Asbestos is still used in products available in the United States such building materials and heat resistant products. Construction workers and utility workers have the type of jobs that usually expose people to airborne asbestos particles on the job, and are the employees most likely to develop mesothelioma. Family members of asbestos workers can also inhale the fibers and develop these illnesses as well. To protect workers and the public from harmful exposures, the EPA and the Rhode Island Department of Health enforce strict regulations on any activities involving asbestos.

Rhode Island Car Accident Attorney: Common Causes of Pedestrian AccidentsAccording to the National Highway Traffic Safety Administration (NHSTA), nearly seventy-thousand people are injured and nearly 5,000 people die in pedestrian accidents every year. Many of the people who are injured sustain serious, sometimes permanent injuries.

Most victims of pedestrian accidents are children under the age of 16. The elderly population has the highest number of pedestrian accident related deaths.

While pedestrian accidents can happen at anytime, statistically most pedestrian accidents happen in the evening on weekends. Two-thirds of pedestrian accidents occur on the street. Whether on a sidewalk, in a crosswalk, walking, or running, pedestrians are vulnerable and at risk of being injured.

Common Causes of Pedestrian Accidents:
• Drivers not paying attention and checking for pedestrians in crosswalks.
• Poorly marked Crosswalks that are not in sync with traffic signals. Using crosswalks with signals lessen the danger.
• Left-Hand Turns: Three times as many people get hit by cars turning left than by cars turning right because the driver is focused on driving through the intersection and the pedestrians is looking straight ahead.
• Drivers turning right on a red light frequently fail to make a complete stop, therefore they don’t see the pedestrians.

• Drivers making turns without paying attention to their surroundings.
• People getting out of the car on the road side, without checking for oncoming traffic.

• Alcohol or Drug Use by pedestrians and drivers. According to the IIHS-Highway Loss Data Institute, thirty-seven percent of fatally injured pedestrian have blood alcohol concentrations of at least 0.08 percent. Intoxicated drivers are involved in 13 percent of pedestrian collisions.
• According to the National Highway Traffic Safety Administration (NHSTA), because battery operated cars are very quiet, pedestrians are 40 percent more likely to get hit, because they don’t hear the car, than by other cars.

Unfortunately, there are times when the driver who caused the accident will leave the scene of the accident without speaking to the the other party involved or speaking with the police – this is considered a Hit and Run accident.

Some common reasons people leave the scene of an auto accident include:

• They have been drinking or using drugs
• They don’t have auto insurance or the car is not registered

If the driver who caused the accident is found, you can file your insurance claim through the at-fault driver’s insurance company, just as you would any other car accident claim. If the at-fault, hit and run driver is found, they will be subject to both criminal penalties and civil liability.

If, however, the at-fault, hit and run driver is never found, you will have to file your insurance claims through your insurance company using your uninsured motorist coverage. Construction Worker Injury Claim

Construction Worker Injury ClaimsConstruction workers work in one of the most dangerous occupations in the United States. According to the U.S. Bureau of Labor Statistics, an average of 12 construction workers are killed on the job each and every day. The leading causes of worker deaths on construction sites were falls, followed by struck by object, electrocution, and caught-in/between.

While working construction jobs, construction workers have to take many safety precautions to avoid being injured while at work. Most states have regulations concerning on-the-job safety training for construction companies. However, if a construction company fails to provide adequate safety training for its employees and an employee becomes injured on the job, the company may be liable for the worker’s injuries.
In most cases the employee can sue their employer even if it was the worker’s own fault that they suffered the injuries.

In order to win a personal injury lawsuit for harm caused by improper safety training, a worker must prove three elements:

  • That the defendant had a duty to provide adequate safety training to the worker
  • That the defendant breached that duty
  • That the breach caused harm

In order for an employee to win a lawsuit against their employer based upon failure to provide safety training, the company must have had a duty to provide safety training to the worker, not all companies involved in construction have a duty to provide safety training for their employees.

In general, if an employer has an employee perform a certain task, the employer has an obligation to ensure that the employee knows how to perform the task safely.

Construction accidents can lead to serious injuries, including permanent disability and death. Some of the most common injuries suffered by construction workers are amputations, burns, fractures, brain injuries, spinal cord injuries, joint injuries, crush injuries and internal organ damage.

In personal injury cases involving these types of claims, it is critical that the injury was due to the employer’s negligence to provide safety training to the employee.

The most common types of damages in a Construction Worker Injury Claim include:

  • Medical expenses
  • Lost wages (for time missed from work due to the injury)
  • Pain and suffering
  • Loss of normal life (the decreased quality of a person’s life as a result of the injury)

Personal Injury Attorney Rhode Island – Discusses Workers Compensation

Personal Injury Attorney Rhode Island Construction Workers at Higher Risk for Accidents Leading To Workers Compensation

Personal Injury Attorney Rhode Island - Discusses Workers CompensationWorkplace injuries can occur in any business or industry. Construction workers have one of the highest worker injury rates of any occupation in the United States. The US Department of Labor Statistics reports that in 2013, 4,585 construction workers were killed on the job, one in five worker deaths last year were in construction. This why you need to know your workers compensation rights.

According to the American Public Health Association, almost all construction workers will sustain injuries on the job at least once in their lifetimes. Data from the Occupational Safety and Health Administration (OSHA) shows that one in ten construction site workers are injured every year. According to the Bureau of Labor Statistics, there are approximately 150,000 construction site injuries each year. Workers between 25 and 34 years old are the most likely to be injured in a construction site accident, and according to OSHA, falls are the leading cause of injury at construction sites.

A construction site accident can cause serious, life-threatening injuries such as: head injuries, brain injuries, burns, blindness, loss of limbs, spinal cord injuries, disfigurement, and even death.

The majority of construction accidents are the result of OSHA violations.

Common violations include:
• Lack of fall protection
• Defective wiring and equipment
• Unstable ladders and scaffolding
• Lack of respiratory protection
• Failing to warn construction workers of hazards in specific locations
• Unsafe heavy equipment and trucks
• Site hazards including gas pipes and electrical lines
• Allowing workers to use equipment without safety guards
• Falling objects
• Missing barricades used to block off trenches and excavations

When a construction worker gets injured on the job, they may be eligible for Workers Compensation, it is estimated that 15 percent of Workers Compensation payouts are for injured construction workers.

Unfortunately, Workers Compensation benefits usually don’t provide enough money to cover the injuries sustained, in part due to the fact that most injuries involving construction workers are injuries to their backs, spines, and trunks. In some cases the injured worker may be eligible for additional compensation as well.

Rhode Island Personal Injury Attorney: How to Avoid Getting Bitten by a Dog

Rhode Island Personal Injury Attorney: How to Avoid Getting Bitten by a DogIt is the legal responsibility of pet owners to ensure that people are safe from their pets. Unfortunately, many dog owners let their pets run loose, don’t keep their pets under control, and are careless even with pets who have been aggressive in the past and may be dangerous to others. Oftentimes this type of pet owner will let their dog roam loose. walk their dog around people without having the dog on a leash, and let their dog approach others – not keeping their dog under control.

Here are some tips for protecting yourself from dog bites and dog attacks.

1. Stop Attack Before It Starts: The first thing you’ll want to do is stop an attack before it starts. Avoid dogs you’re not familiar with if they are not under the control of the owner, and are not on a leash. It is also important to be familiar with the signs of an aggressive dog, or a dog that is upset, when a dog is preparing to attack, they try to make themselves appear larger. Signs to look for include, a tense body, an intense stare, pulled back ears, raised fur and a stiff tail. The dog may bare their teeth, growl and bark. In some cases yawning may be a sign that a dog is uncomfortable or tense – which may cause the dog to attack. If a dog is afraid, the dog will try to make themselves look smaller, they may crouch, put their tail between their legs, and flatten their ears back. Remember a frightened dog may also bite you.

2. Acting Competitive: For most people, their natural instinct is run away and even scream when approached by an aggressive dog. This is the worst thing to do when you’re around a dog that is getting ready to attack. If the dog is acting aggressive towards you – barking or growling – you don’t want to act competitive (by running or screaming) and you don’t want to “act like prey.” While you may be scared, your best recourse is to stand perfectly still and avoid eye contact with the dog until the dog loses interest or the dog’s owner gets the dog under control. Once the dog looks as if it has lost interest, you need to back away from the dog very slowly, again do not run.

3. Teach Children Dog Safety: It is important to teach your children dog safety as well. The majority of people injured by dog bites are children under age 14. Most children will approach every dog, including strange dogs, because they are fascinated with animals, they assume that every animal wants to be their friend. It is important to teach your children the following: don’t approach a dog you don’t know, always ask the owner before approaching or petting their dog, do not touch or approach a dog who is sleeping or eating. Teach your children what to do if a dog attacks them.
Also teach your children to never chase dogs or tease dogs.

4. Stay Away From Unfamiliar Dogs: Never assume a dog is friendly, all dogs can become aggressive in certain circumstances. The best way to avoid being attacked or bitten by a dog is to stay away from dogs that you are unfamiliar with. You should also remain cautious around dogs that you are familiar with who have been friendly in the past. Do not assume because a dog is calm around his owner, that the dog will remain calm and friendly when approached by a stranger. As dogs get older they can get aggressive, small dogs can be aggressive and dangerous, and dogs on a leash can still attack you. Never assume that you or children are safe when around a dog, always be prepared because you don’t know what can cause a dog to attack. Dogs have been known to attack and kill their owners who have had them for years.

Personal Injury Attorney Rhode Island: Common Car Accident Injuries

Personal Injury Attorney Rhode Island: Common Car Accident InjuriesCar accidents are a leading cause of injuries. Over 5.6 million car accidents were reported in the United States in 2012. Of these, over 30,000 of were fatal and another 1.6 million involved other injuries.

In 2013, there were over 5.6 million car accidents in the United States. Of these, over 1.6 million involved injuries and 30,000 resulted in death.

Being involved in a car accident is an extremely traumatic experience that can result in serious injuries and even death. When people are hurt in a car accident, the most common injuries are to the head, the neck, and the back. Other common injuries involve the internal organs, legs, and arms.

Common Car Accident Injuries Include:

Whiplash
The term “whiplash” is a non-medical term frequently used to describe a range of neck injuries following a car accident A whiplash injury is an injury that affects the soft tissues of the neck. It is a neck sprain or neck strain and is most common in rear end collisions. Fortunately, a whiplash injury is not usually a life threatening injury, however, it can lead to a prolonged period of partial disability.
More severe neck injuries such as a broken neck can result in instant death. Other neck injuries may crush the larynx or trachea.

Back Injuries
Suffering a back injury when involved in a car accident is very common. If there was injury to the spinal cord, one can suffer nerve damage. A herniated disc is another common back injury that people suffer in car accidents, while less severe than an injury to the spinal cord, this injury can cause significant problems.

Traumatic Brain Injury
TBI, or traumatic brain injury, is an extremely complex and damaging auto injury occurring more commonly in side impact crashes.TBI can be mild and temporary like a concussion, or cause permanent impairment of critical brain functions uch as speech, vision, concentration, memory and emotional control.

Head Injuries
Other head injuries such as eye injuries, which can result in partial vision loss or blindness; injuries to the ear that result in loss of hearing; facial or jaw fractures; and dental injuries, including loss of teeth.

Chest Injuries
Chest injuries are very common car accident injuries. These injuries typically present themselves as contusions or bruises, but can be more severe, such as broken ribs or internal injuries. Drivers often experience chest injuries when their chest collides with the steering wheel. If a person’s body is thrown forward in a collision, even though it might not impact the steering wheel or dashboard, the chest area will still experience a high level of force against the shoulder harness or seat belt, which can cause severe bruising and internal injuries.

Pelvis/Abdominal Injuries
The impact of a motor vehicle accident can cause internal injuries, many of which are life threatening. These types of injuries include injuries to bowels, kidneys, the spleen, liver, lungs, heart or aorta. Fractured ribs are also quite common, and can puncture the lungs.

Arm and Leg Injuries
Arm and leg injuries are typically the result of crush injuries sustained in a car accident. Common injuries to the arm and legs are strains, sprains, and fractures.

Psychological Injuries
Many people involved in car accidents suffer emotional distress such as anxiety, insomnia, depression and post-traumatic stress disorder (PTSD). Psychological injuries can have long-lasting effects.
Studies of car accidents have shown that the severity and type of injury sustained in a car accident is determined by where a person is seated in the car. The closer one is seated to the point of impact, the more severe the injuries.
